- Disclaims any responsibility for Service User Generated Content.
- Cannot be held liable for any claims that arise from or relate to Service User Generated Content.
- Is under no obligation to monitor, review, or remove Service User Generated Content but reserves the right to limit or remove such content from the Services at its discretion.

You hereby represent and warrant to CyberSynapse that your Service User Generated Content (i) will not be false, inaccurate, incomplete, or misleading; (ii) will not infringe any third party’s copyright, patent, trademark, trade secret, or other proprietary right or any rights related to publicity, personality, or privacy; (iii) will not violate any law, statute, ordinance, or regulation (including, but not limited to, those regarding export control, consumer protection, unfair competition, anti-discrimination, false advertising, anti-spam, or privacy); (iv) will not be defamatory, libelous, unlawfully threatening, or unlawfully harassing; (v) will not be obscene, contain pornography (including child pornography), or be harmful to minors; (vi) will not include any viruses, Trojan Horses, worms, time bombs, cancelbots, or other harmful programming that could damage, interfere with, intercept, or expropriate any system, data, or personal information; (vii) will not falsely represent you as an employee, agent, or direct affiliate of CyberSynapse; and (viii) will not create liability for CyberSynapse or jeopardize its relationships with ISPs or other service providers.  

By submitting any Service User Generated Content through the Services, you grant CyberSynapse an irrevocable, worldwide, perpetual, non-exclusive, royalty-free, transferable license, with the right to sublicense, to use, access, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, and otherwise exploit such content via the Services. Unless otherwise specified in any other agreement between you and CyberSynapse, CyberSynapse does not claim ownership over your Service User Generated Content, and this Agreement does not limit your rights to use and exploit your own content.

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. ‍Governing Law and Jurisdiction

No waiver of by CyberSynapse, a division of The CyberNest of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of CyberSynapse , a division of The CyberNest to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
